The Authentication (Certification) of the signatory person’s signature consists of: Commercial documents such as invoices and certificates of origin, need to be certified by Ministry of Commerce, The Thai Chamber of Commerce or The Federation of Thai Industry. Issued under the Regulation of Lawyers Council of Thailand about applying to be Notarial Services Attorney B.E. 2551, announced into Government Gazette dated January 8, 2009.

Qualification of Notarial Services Attorney (Notary Public)

• Having Attorney License issued by Lawyers Council of Thailand
• Currently not under any accusation of professionalism case under the Section 51(2) or under any investigation of such cases.
• Have never lost the license due to a case of professionalism.
• Have been trained, and have attended seminars in accordance with the regulation of Lawyers Council of Thailand.

Registration License of Notarial Services Attorney (Notary Public)

• Have passed the training and examination as described by Lawyer Council of Thailand
• Have received the Certificate issued by Lawyer Council of Thailand
• Have received the registration number
• Have received the Notarial seal
• Have been informed to Ministry of Foreign Affairs and Thai Embassies aboard

Case not approved for the Notary License, or not accepted to renew the Notarial License

• Clarification and reasons
• Applicant has the right to appeal to “Lawyers Council of Thailand” (Ministery of Justice) within 30 days from the date of un-approval

Area of service:

• No restriction, can serve within all territories of Thailand

Duration:

• 2 years
• Able to renew within 90 days before expiration

Fee

• No enforcement by law
• Using fair rate
• To avoid any dispute, the fee should be informed in advance.

Work activities of Notarial Services Attorny

• To follow the 10 guidelines of Lawyers Council of Thailand
• Details are in the manual of Lawyers Council of Thailand
• Notarial Services Attorney must present their Notarial Services Attorney card to client
• Notarial Services Attorney must explain their duty and work to their client
• Authentication must be clear. The scope, purpose, quantity, etc. must be clearly stated to protect Notarial Services Attorney
• Must not certify a false statement, and must not issue certification from in-complete information
• Must not involve in any false statement or any false activities
• Must keep the record, and keep copies of certifications issued
• Confidentiality

Authority of Notarial Services Attorney:

• Can certify the facts, the truths, objectives of agreement, genuineness of the objectives of agreement, genuineness of signatures in the agreement, having enforcement by the law.
• Case of preparing agreement – if having a dispute in the court, both parties need to testify in the court.

Record keeping, Must have at least:

• Date of receiving document
• Name and address of applicant
• Name of the owner of the document
• Name and/or type of document
• Date, month, year of certification
• Keep one set of copies of the certification of the agreement for five years from the latest certification date
• Allow to be checked by the authorities

Insurance:

• No regulation by law for Notarial Services Attorney to have or not to have insurance.

Termination

• No longer a lawyer
• Do not renew the license
• Get punishment for the professionalism case under Section 52 (2).
• To certify against the regulation of Lawyers Council of Thailand,  or against the practice approved by Lawyers Council of Thailand.
• Lack of qualification before or after getting the license.
